Good news from Indonesia! Calling all artists, content creators, writers, composers, software developers and other artistic and creative workers – if you’ve ever had any doubts on how to prove copyright ownership of your work, then doubt no more as having your artistic creations legally recorded with the Directorate General of Intellectual Property (DGIP) is now a simple and straightforward process!
Key Takeaways
- POP-HC Launch – Indonesia’s Directorate General of Intellectual Property (DGIP) introduced “Persetujuan Otomatis Pencatatan Hak Cipta” (POP-HC), an automatic copyright recordation approval system.
- Fast Processing – Under POP-HC, copyright recordals are approved automatically within 10 minutes after payment, provided the work meets specific requirements.
- Eligibility Requirements – The work must not be a copy, traditional cultural expression, unknown-author work, unprotected subject matter, logo or mark used as a trademark or organizational symbol, or content violating laws, morals, or public order, and must not be in ongoing legal disputes.
- Purpose and Benefits – Although copyright protection is automatic upon creation, official recordation strengthens proof of ownership, supports commercialization, and helps resolve disputes.
- Call to Action – Creative industry professionals are encouraged to record their works to safeguard rights and enhance their commercial potential.
Protect Your IP Today.
The DGIP has been stepping up their services to the public, and this time, the object of their never-ending quest for innovation and transformation has been the issuance of Decision No. HKI-05.TI.03.02 of 2021 re. Implementation of Automatic Approval in Copyright Recordation System or in Indonesian, “Persetujuan Otomatis Pencatatan Hak Cipta” or “POP-HC”.
What’s POP-HC? POP-HC is a system that enables the DGIP to accept and process applications for copyright recordals, whereby approval will automatically be generated upon payment. With the POP-HC system, copyright recordals will take only 10 minutes, as long as the creation fulfils the following requirements:
- Not a copy and not essentially similar to other intellectual properties or creations belonging to other parties
- Not an expression of traditional culture
- Not a work of an unknown creator
- Not a work that is not protected by Copyright
- Not an artwork in the form of logo or a distinguishing mark used as a trade/service mark or used as a symbol of an organization, business entity, or legal entity
- Not a work that contravenes religious norms, moral norms, public order, state defence and security or laws and regulations
- Never been and not currently in a criminal and/or civil dispute in court
People in creative industries are well aware of the importance of copyrights. While it is true that copyright protection is automatically gained once the work is published or expressed in a tangible medium, taking the additional small step of recording the copyright at the DGIP is encouraged, for the sake of proving legal ownership and validity. Copyright recordals are also crucial in the commercialization of an artistic creation.
