In line with Indonesia’s ongoing efforts to strengthen its intellectual property framework, the Law No. 65 of 2024 (Third Amendment to the Patent Law) introduces a clear requirement for all patent holders to submit an annual Statement of Working for every granted Indonesian patent.

Our Direct Engagement with DGIP
To provide clarity for our clients, our team has proactively engaged with officers from the Directorate General of Intellectual Property (DGIP) to better understand how this new requirement will be enforced.
Based on DGIP’s written confirmation to us in early October 2025, we highlight the following key points:
- The Statement of Working must be submitted by the end of each calendar year.
- The obligation applies to all active patents.
- It must be submitted annually until the patent expires.
- The requirement has been effective since 28 October 2024.
- There is no immediate penalty for non-submission in the same year. Submission can still proceed once ready.
- Late submission is permitted together with the next annuity payment.
- Failure to submit for three (03) consecutive years may expose the patent to compulsory licensing.
- Submissions are made to the Director of Patents, DTLST and Trade Secrets, and are currently free of charge (no official fee).

The Statement of Working only requires the Applicant’s signature and no supporting documents at this stage. You may access and complete the form directly from DGIP’s website as provided in item 9.
For active granted Indonesian patents, we recommend submitting the Statement by 31 December 2025 wherever possible to stay ahead of any procedural changes or possible introduction of official fees once full enforcement begins.
