A trademark is more than a legal requirement, it’s a vital business asset. Without it, your brand is at risk of theft, misrepresentation, and dilution. Worse, you could lose your rights if someone else registers a similar trademark first. Registering your trademark, however, provides exclusive rights, strengthening your competitive edge. It enhances credibility, showing professionalism to customers and investors. Most importantly, it secures your brand’s identity, protecting it for the long term.
  1. The trademark application/ registration number(s).

  2. The full name and address of the Assignor.

  3. The full name and address of the Assignee.

  4. The date of the assignment.

  5. Information as to whether the application is for a full assignment or partial assignment (please specify which classes).

  1. The relevant form to appoint ourselves as agent for the Assignor and/or Assignee (TMR7). This document will be prepared on our end.

  2. The Form TMH1. This form must be signed by both the Assignor and the Assignee. Legalization or notarization is not required. Scanned copy is sufficient.

  3. A Deed of Assignment (if parties could not execute the form TMH1). Legalization or notarization is not required. Scanned copy is sufficient.                       

Notes: As the assignment form above is not a substitute for the assignment document or other proof of the transaction, it is also advisable for the parties to execute a Deed of Assignment to clearly specify the terms of the transfer of ownership. Having said that, a Deed of Assignment is not mandatory for filing the assignment once the parties have signed the Form TMH1. 

The timeline for a trademark assignment typically takes 4 to 8 months from the date of submission.

  1. A copy of certificate of change of name or other official evidence effecting the change of name as issued by the relevant authorities. Legalization or notarization is not required. Scanned copy is sufficient.

  2. If the certificate of change of name is not in the English language, a certified English translation of the certificate of change of name is required.

The timeline for a trademark assignment in Malaysia typically takes 4 to 8 months from the date of submission to MyIPO.
